Privacy Policy: A document outlining how an organization collects, uses, and protects personal data. Ensures transparency and compliance with data protection laws.
Job Seeker: An individual searching for employment opportunities or related information. This includes those using Instaploy’s services to apply for jobs and enhance their career prospects.
Employer: Organizations or individuals seeking to hire job seekers. This includes companies, recruitment agencies, and human resource departments using Instaploy’s platforms and or services to post job openings and or to benefit from our services.
Non-Personal Data: Information that does not identify a specific individual. Examples include aggregated data and business-related information.
Your Information: A combination of Personal and Non-Personal Data related to you. This includes all data collected through your interactions with our services.
Controller (or, under the CCPA, “Business”): The entity that decides how and why your data is processed and is responsible for compliance with applicable U.S. privacy laws.
Service Provider (also called a Processor): An entity that processes data on behalf of a Business/Controller, following its instructions and safeguarding data confidentiality.
Instaploy: Includes all Instaploy platforms and team members responsible for delivering services.
Relay Service: A two-way message proxy service for Instaploy users. Facilitates communication between job seekers and employers while protecting privacy.
Job Listings: Employment openings listed on Instaploy’s platforms. Searchable by job seekers looking for opportunities.
Instaploy Profile: Includes resumes, assessment results, screener question answers, Job application, video interviews, video screeners, all types of recorded communications, contact information stored in your Instaploy job seeker account.
Resume: A document detailing work history, education, and skills. Used by job seekers to apply for jobs and by employers to evaluate candidates.
ATS: Applicant Tracking System used by employers to manage the recruitment process. Helps organize applications, screen resumes, and schedule interviews.
Consumer (also called a Data Subject): The individual whose personal data is processed, who may have rights under applicable U.S. privacy laws to control their information.
Consent: Permission given by the data subject for their data to be processed. Must be informed, specific, and revocable.
Data Breach: A security incident where personal data is accessed, disclosed, or destroyed without authorization. Requires notification to affected individuals.
Personal Data: Information that identifies or can identify an individual. Examples include names, contact details, device information, and IP addresses.

Our Privacy Policy details how we collect, use, and share personal and non-personal data when you interact with our online and mobile websites, applications, services, software, phone or video communications, in-person interactions, or, where permitted by applicable law and this Privacy Policy, from public sources or third parties.
Data Hosting and Sharing:Personal data submitted by job seekers, including profile information, is hosted on Instaploy’s platform. This data is shared with potential employers as part of the service offered by Instaploy to facilitate employment opportunities for job seekers.
Protection of Data on Our Platform:Instaploy commits to employing high standards of security measures and data protection practices to safeguard personal data while it remains under our control. We strive to protect your profile data against unauthorized access and misuse.
Limitation of Liability for Data Use by Third Parties:While Instaploy takes reasonable precautions to protect personal data on its platform, we do not assume responsibility for the actions of potential employers who receive such data. Once personal data is shared with potential employers, Instaploy expressly disclaims liability for any misuse, loss, or unauthorized use of such data by these third parties. Users acknowledge that the sharing of their data with potential employers is a fundamental part of the employment facilitation process provided by Instaploy.
User Consent:By using Instaploy’s services, job seekers consent to the hosting and sharing of their data as described above and acknowledge Instaploy’s limited liability regarding the subsequent use of the data by third parties.
EXTENT OF INSTAPLOY’S PRIVACY POLICY
This Privacy Policy covers the data we collect via our Site, directly from users, or from third parties. When you follow a link to a third-party website, our Privacy Policy no longer applies. Data collection or processing on such websites is governed by their respective privacy policies. We only collect data on the Instaploy site that link directly to this Privacy Policy.
Our site and applications are generally intended for individuals aged 18 and older.
In the United States, if you are under the age of majority in your state, you must use the Sites under the supervision of a parent, legal guardian, or responsible adult, even if you meet the minimum age requirement for using the Site in your jurisdiction.
If we discover that a person who does not meet these age requirements has used the Site or provided personal information, we will restrict access or close their account and remove their information from our systems.

In determining retention periods, we consider the processing purposes, alternative means, the extent, nature, sensitivity of the data, and legal obligations. When Instaploy acts as a processor of your personal data, we store such data until instructed to delete it by the individual.

EXPANDED USES AND DISCLOSURE OF INFORMATION
When you create a searchable resume or upload your resume to our platform, or submit any information to us including video screenings and interviews you permit us to share your resume and all profile details with third parties as described in our General Terms of Service. By default, your resume and profile is set to searchable, and shareable meaning potential employers and other third parties can access your profile and resume data if we choose to share it with them for the purposes of presenting your profile for potential employment.
Employers and their representatives who access your searchable resume and profile, or to whom you apply with a non-searchable resume, may further share your resume and profile. We are not responsible for such sharing. Additionally, when you share your resume or profile on our platform via a personalized link, even if it’s a link to your profile on our platform, we cannot control who accesses it.
You can adjust your resume privacy settings at any time. If you prefer that your resume data is not shared without your explicit direction or if you do not want to be contacted by employers, set your resume to non-searchable and non-sharable. For more information on resume privacy settings, please visit your profile settings.
As we improve our platform, you may see terms like ‘Employers can find you’ and ‘Employers can’t find you’ to better explain searchable and non-searchable statuses and sharable or non-shareable statuses.
Employer Account Integration: We provide the option for employer user accounts, enabling designated users to access candidate personal data within the parent account. If you link other users to your employer account, you agree that these users may access all information, including resume profiles contacts, application materials, communications with applicants, and can purchase and unlock profiles. Once a user account is deactivated or delinked, access to candidate personal data from the linked account will be lost.
Resume Enhancement Services: In certain cases, we offer resume enhancement services to assist job seekers in improving their resumes. These services may include changes to how your resume is processed or presented by our applicant tracking systems, including introductions, candidate overviews, list if skills submitted to us during your application process, and including your profile picture can be added to your resume as it gets reformatted. This reformatted resume and profile can be shared by us with potential employers to increase your chance to be considered for the job, and by using our platform you agree and consent to us reformatting your resume into our template.
Automated Data Processing: We use automated processing of personal data to evaluate user preferences and predict interests. This is done either based on user consent or as necessary to provide our services. This processing helps match job seekers with suitable employers, provide job alerts, recommend jobs, and protect users through spam and fraud detection. These activities are conducted under the safeguards of our Privacy Policy. Contact Privacy@instaploy.com to exercise your rights or contest any automated processing decisions made to your profile.
Recording of Site Activities: We reserve the right to collect, process, and analyze all activities and interactions you have on our site and software platform. This data helps us improve our services and enhance the user experience. This includes details such as visited areas, viewed content, entered information, submitted information, clicks, scrolls, and time spent on activities. Third-party vendors may assist in collecting and processing this data on our behalf. Your activity data helps us understand site usage, improve our products, and assist you in finding jobs. If you prefer not to have your actions collected in this manner, you may need to stop using our sites, by using our site you agree and consent to all our activities

USER RIGHTS REGARDING PERSONAL DATA
Access and Portability Rights
As a user of our Sites, you may have certain personal data rights. You may make a formal request to access your personal data (also referred to as the “right to know”) by filling out this Personal Data Request form or by sending an email to Privacy@instaploy.com from the email address associated with your account. You can access much of your personal data directly through your account.
You have the right to request that we disclose the personal data we collect, use, disclose, and “sell” or “share” (for purposes of the CCPA) about you. We will provide your personal data to you in a portable format. If you have interacted with our Sites using more than one email address, please submit a separate request for each email address to ensure we provide all relevant data.
Right to Rectify Personal Data
You have the right to correct your personal data. You can update much of your personal data by editing your account profile information directly. You may also make a formal request to have Instaploy rectify any inaccurate, incomplete, or outdated personal data on your behalf by sending an email to Privacy@instaploy.com from the email address associated with your account.
Right to Delete Personal Data
You have the right to request the deletion of your personal data, also known as the “right to erasure.” You can delete much of your personal data by removing it directly from your account. If you wish to exercise your right to erasure and close your account, please submit a Personal Data Request Form. You may also request that we delete your personal data by sending an email to privacy@instaploy.com from the email address associated with your account.
By making a personal data deletion request, we will permanently close and delete your account and remove access to your profile on Instaploy.
Withdrawing Consent
Where we rely on your consent as a lawful basis to process your personal data, you have the right to withdraw your consent at any time. Instructions on how to withdraw consent will be explained to you at the time you are asked to provide your consent. If you have consented to provide location information via a mobile app, you may turn off your location services on your device at any time. You may also contact privacy@instaploy.com to inform us that you are withdrawing your consent.
Opt-Out Rights
You may have the right to opt out of certain personal data processing. If you wish to adjust all of your Job Alerts, you can click on “Edit this job alert” (or an equivalent action) to adjust your subscriptions.
Marketing Messages: If you wish to opt out of a particular marketing email, you may do so by clicking “unsubscribe” (or an equivalent action) where applicable. You may also opt out of all marketing messages by sending an email to privacy@instaploy.com Please note that we may still send other non-marketing messages to you, such as administrative messages.
Conversion Tracking: We perform conversion tracking to improve our understanding of your application journey. You may opt out of conversion tracking by sending a request to privacy@instaploy.com
Non-Discrimination for Exercising Rights
We will not discriminate against you for exercising any of your rights.
Limitations and Additional Notes
These rights may be subject to certain limitations, as provided for by applicable U.S. laws. Requests will be completed within the time allotted by relevant regulations, starting from the point of us confirming your request. Deleting your personal data held by Instaploy does not affect messages we process on behalf of others in connection with their use of Instaploy’s Relay Service, and they may continue to have access to all messages sent to or received from you.

Relay Services: When using any Relay Service, you are requesting Instaploy to send messages on your behalf. This includes resumes, cover letters, applications, messages, questionnaire responses, offer letters, and other materials. Instaploy may provide read receipts to the sender of a message via a Relay Service, indicating that the recipient has viewed the message. Additionally, Instaploy may inform both the sender and recipient of a message through a Relay Service whether the sender or recipient has been recently active on the Site.

Sending Reminders About Employer Appointments: When an employer or our recruiter schedules an interview or event with you, contacts you based on your resume/ profile or responds to your application via Instaploy’s Relay Service, messaging platform, you will enter your phone number on a Instaploy consent form. By entering your phone number and consenting, you confirm that it is your number and you have the right to receive messages and phone calls at that number, which will be sent by a third-party service provider. To unsubscribe from text messages, reply STOP to the text or contact the Help Center. To unsubscribe from phone calls, follow the instructions provided during the call.
Telephone Relay Services: Instaploy offers job seekers and employers the option to use a telephone Relay Service, messaging services, and video conferencing services to facilitate contact for applications, job interviews, or other communication related to a job listing. This system uses masked or proxy telephone numbers to protect users and is only available to those who select it on the Site. This functionality is provided by third-party service providers.
Text Messaging Relay Service: Instaploy provides its users and employers the ability to use an text messaging service for communicating with job seekers, you consent to receive text messages about the employer’s job listings and the application process, and acknowledge that Instaploy may use your personal data to submit your application to the employer and otherwise in accordance with this Privacy Policy. Data on Job Seekers: Disposition Data refers to information about the status of your job application and the employer’s decision, such as whether your application advanced to the interview stage or if you were accepted or declined for the position. AUTOMATED DECISION-MAKING AND YOUR RIGHT TO HUMAN REVIEW
Instaploy uses automated processing of personal data, including profiling, to operate and personalize the service — for example, to generate and rank job matches, surface recommendations and job alerts, prioritize content, and detect spam and fraud. We use these tools to assist and inform human decision-making, not to replace it. We do not make hiring, rejection, or other consequential employment decisions about you based solely on automated processing and without human involvement. The employers who use Instaploy make their own hiring decisions and are independently responsible for the lawful use of any tools they apply.
Where a decision about you is based solely on automated processing and produces legal effects concerning you or similarly significantly affects you, you have the right to: (a) be informed that the decision is automated; (b) receive meaningful information about the main factors and logic involved and the significance and likely consequences of the processing; (c) express your point of view; (d) obtain human review of the decision by a qualified Instaploy team member; and (e) contest the decision. Where required by applicable law, we will give you advance notice that automated decision-making technology will be used for a significant decision and an opportunity to opt out. To exercise any of these rights, email Privacy@instaploy.com with the email address associated with your account. We will respond within the period required by applicable law and, in any event, without undue delay. These protections are provided consistent with the California Consumer Privacy Act as amended (including its regulations on automated decision-making technology, or “ADMT”), the Colorado Artificial Intelligence Act, and similar U.S. laws as they take effect.
ALGORITHMIC FAIRNESS AND NON-DISCRIMINATION
We are committed to designing, testing, and monitoring our matching and ranking systems to reduce unlawful bias and to operate consistently with applicable equal-opportunity laws, including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and U.S. Equal Employment Opportunity Commission guidance on the use of artificial intelligence in employment. Instaploy provides tools that assist employers; it does not make hiring decisions. To the extent any Instaploy tool is determined to be an “automated employment decision tool” under New York City Local Law 144 of 2021 or a similar law that applies to Instaploy directly, we will take the steps that law requires, which may include an independent bias audit, public disclosure of the audit summary the law requires, and candidate notice and alternative-process or accommodation options. You may request a reasonable accommodation or an alternative process in connection with any automated assessment by contacting Privacy@instaploy.com.
BIOMETRIC DATA — WE DO NOT COLLECT IT
Instaploy does not collect, capture, or store biometric data. When you use our voice features or take part in a recorded video interview, we may record and process the audio, video, and a transcript of your responses and analyze their content using artificial intelligence — but we do not create or store voiceprints, faceprints, facial-geometry scans, or voice-recognition templates, and we do not use facial-recognition or voice-recognition technology to identify you. Accordingly, we do not collect “biometric identifiers” or “biometric information” within the meaning of the Illinois Biometric Information Privacy Act, the Texas Capture or Use of Biometric Identifier Act, the Washington biometric-privacy statute, or comparable laws. If our practices ever change, we will update this policy and obtain any consent the law requires before collecting any biometric identifier.
AI-ASSISTED VOICE AND VIDEO INTERACTIONS
When you interact with an artificial-intelligence system on Instaploy, such as our conversational voice agent or a chatbot, we will tell you that you are interacting with artificial intelligence rather than a human, consistent with applicable U.S. artificial-intelligence transparency laws. Where you take part in a video interview that may be analyzed by artificial intelligence, and where the Illinois Artificial Intelligence Video Interview Act or a similar law applies, we (and, where applicable, the employer) will, before the interview, notify you that AI may be used, explain in general terms how the AI works and what types of characteristics it evaluates, and obtain your consent; we will limit who receives your video to those whose expertise or technology is necessary to evaluate you; and, on your request, we will delete your video interview within thirty (30) days and instruct any recipients to do the same. Outputs from AI systems may be inaccurate, so please verify anything important to you.
THIRD-PARTY AI SERVICE PROVIDERS
We use carefully selected service providers to help deliver the service, including providers that power our artificial-intelligence features. These providers act on our behalf under written agreements (including data-processing terms) that require them to protect your data, use it only to provide services to us, and not to sell it or use it for their own unrelated purposes. We also use established cloud-hosting, communications, analytics, and security providers. Instaploy operates in the United States, and personal data is stored and processed in the United States. We will provide further detail about our material service providers on request at Privacy@instaploy.com.
HOW LONG WE KEEP YOUR DATA (RETENTION SCHEDULE)
We keep personal data only for as long as necessary to fulfill the purposes described in this policy, to provide the service, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by data type. The following are general guidelines and may be shortened or extended where the law requires or permits, or where data is subject to a legal hold.
Account and profile data (including your name, contact details, resume, and application materials): kept for the life of your account and for a reasonable period afterward — generally up to twenty-four (24) months after account closure — unless a longer period is required by law or you request earlier deletion. Recorded communications and video interviews: kept for the period needed to provide the service and improve our products, and deleted within thirty (30) days of a valid deletion request as described above. Records of consent and communication preferences (including SMS consent and opt-out records): kept for as long as needed to honor your preferences and to demonstrate compliance, generally for the duration of the relationship plus the applicable limitations period. Transaction, billing, and tax records: kept for the period required by applicable financial and tax laws. Security, fraud-prevention, and audit logs: kept for a limited period appropriate to the purpose. Aggregated or de-identified data that no longer identifies you may be kept and used without the time limits above. When a retention period ends, we will delete, anonymize, or securely destroy the data.
